CANADIAN SAFE SPORT PROGRAM (CSSP) PUBLIC REGISTRY
 

You are entering the CSSP Public Registry (the “Registry”). You must agree to the following terms and conditions to access the Registry. For further details, please consult the Policy regarding the CSSP Public Registry . The CCES manages personal information related to the Registry in accordance with its privacy policies.

Unless otherwise defined in these terms and conditions, capitalized terms have the same meaning assigned to them as in the Universal Code of Conduct to Prevent and Address Maltreatment in Sport (the "UCCMS").

  1. Purpose of the Registry

The Registry is a searchable database of Participants whose eligibility to participate in sports has been restricted due to sanctions and in some cases provisional measures. The aim is to prevent and address maltreatment in sport, in accordance with the objectives of the UCCMS and the mandate given to the Canadian Centre for Ethics in Sport (“CCES”) by the Government of Canada. Provisional measures and sanctions are applied to ensure a safe and respectful sport culture, and to uphold the integrity of the Canadian sport system.

The Registry is necessary to meet the objectives of the UCCMS and is publicly searchable as required by the UCCMS. In accordance with the UCCMS, the Registry only provides sufficient information to provide context to the applicable restriction (in the case of provisional measures) or the Prohibited Behaviour and sanction (in the case of a sanction). Personal information found on the Registry was obtained with consent or was already publicly available, such as on the OSIC Public Registry.

The Registry sets out two types of restrictions: (1) Sanctions and (2) Provisional measures. Sanctions are penalties imposed once there has been a finding that a violation of the UCCMS and/or the CSSP Rules has occurred. Sanctions will be posted to the Registry for the period during which the sanction is in effect, where the sanction includes a suspension, permanent ineligibility or, in the CCES’s sole discretion, other sanctions that restrict eligibility to participate in sport. Sanctions under review or appeal will be indicated on the Registry.

Provisional measures are protective and imposed while investigations into alleged violations of the UCCMS/CSSP Rules are ongoing. They are not indicative of a violation or admission of a violation. Provisional measures that involve a suspension or that restrict the eligibility to participate in sport of a coach or other person in authority, will be posted on the Registry. Summary: The Registry is a public database of Respondents whose eligibility to participate in sport has been in some way been restricted, along with summary information on the UCCMS/CSSP Rules violation.

  1. Permitted Use

The Registry may not be used for commercial purposes. It must be used for the purpose of achieving the objectives of the UCCMS to foster a safe sport environment.

It may be a Prohibited Behaviour under the UCCMS, CCES policies and procedures, including the CSSP Rules, criminal laws, civil laws, and/or any applicable legislation or statute, to use information on the Registry to threaten, coerce, intimidate, or harass an individual, including those listed herein, their family members, or other related person. This conduct is strictly prohibited and is construed as an unauthorized use of the Registry.

Summary: The Registry is for achieving the objectives of the UCCMS of fostering a safe sport environment; using its information for commercial or harmful purposes is prohibited.

  1. Intellectual Property

The Registry belongs to the CCES. The CCES has all intellectual rights to the Registry, including any changes or additions, modifications, and derivative works, and any other work or service provided by the CCES. When you access the Registry, you are only granted a limited right to access and/or use the Registry as outlined above. You do not get any ownership or rights to the Registry, or any of its information. Nothing herein constitutes a waiver of the CCES’s intellectual property rights under any law.

Summary: The CCES retains all intellectual property rights to the Registry, granting users only limited access and use without any ownership or rights to its content.

  1. Legal Framework

These terms and conditions do not form part of, override, or replace: (1) the UCCMS; 2) the CCES’s policies and procedures, including policies relating to the CSSP, such as the CSSP Rules; (3) applicable professional standards and obligations; or (4) applicable laws (altogether, the “Overarching Policies”). The Overarching Policies may also include terms and conditions that apply to your access and use of the Registry.

If any of the terms set out in these terms and conditions are deemed invalid or unenforceable for any reason (including, but not limited to, the exclusions and limitations set out above), then the invalid or unenforceable provision will be severed from these terms and conditions and the remaining terms and conditions will continue to apply. Failure by the CCES to enforce any of the provisions set out in these terms and conditions or Overarching Policies, or failure to exercise any option to terminate, shall not be construed as waiver of such provisions and shall not affect the validity of these terms and conditions or any Overarching Policies or any part thereof, or the right thereafter to enforce each and every provisions.

Summary: These terms and conditions do not replace the Overarching Policies, and if any part is found invalid, it will be removed without affecting the rest, which will still apply.

  1. Release of Liability

By using the Registry, you consent to and agree to any and all of the terms and conditions outlined herein and expressly release, waive, and forever discharge the CCES (and its affiliates), both jointly and severally, from all actions, suits, claims, and demands arising out of or relying upon the Registry.

The CCES (and its affiliates) makes no warranty, representation, or guarantee as to the content or completeness of the information in this Registry. The CCES expressly disclaims any and all liability for any loss or injury caused, in whole or in party, by its actions, omissions, or negligence in procuring, compiling, or providing the information contained in this Registry, including, without limitation, liability with respect to any use of this Registry, or the information contained herein. You are solely responsible for any risks associated with relying upon the information in this Registry. The information in this database may be changed or modified at any time. Any individual who believes that information contained in this Registry is not accurate should contact the CCES’s Privacy Officer at [email protected].

Summary: By using the Registry, you agree to its terms, release the CCES and its affiliates from any claims, acknowledge that the CCES is not responsible for the information's accuracy, and accept any risks from using the Registry's information.
